1. Acceptance of Terms

By accessing or using Tippas ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Tippas is a platform that connects service providers (servers, bartenders, stylists, and other professionals) with customers. The Service allows customers to:

• Discover and browse service providers
• Send tips directly to service providers
• Book services with providers
• Rate and review service providers
• Message service providers

3. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not create multiple accounts or share your account

4. Service Provider Terms

If you register as a service provider, you additionally agree to:

• Provide accurate professional information
• Maintain appropriate licenses and certifications as required by law
• Respond to booking requests in a timely manner
• Honor confirmed bookings or provide reasonable notice of cancellation
• Provide services in a professional and safe manner
• Comply with all applicable laws and regulations

5. Payments, Tips, and Withdrawals

All payments are processed through Stripe. By making a payment, you agree to:

• Tips: Tips are voluntary payments sent directly to service providers. Tips are non-refundable once processed.
• Booking Payments: Service bookings require payment to confirm. Refund policies for bookings are determined by the service provider.
• Platform Fees: Tippas may charge processing fees for transactions as disclosed at the time of payment.
• Taxes: Users are responsible for any applicable taxes on payments received.

Withdrawals for Service Providers:

• Service providers must connect a Stripe account to receive payouts
• Minimum withdrawal amount is $100
• Standard Withdrawals: No fees apply. Processing fees are waived by Tippas.
• Instant Withdrawals: A flat $15.00 fee applies for instant processing (funds within 30 minutes). No other fees apply.
• Standard withdrawal funds typically arrive in your bank account within 2-3 business days
• Tippas is not responsible for delays caused by Stripe or banking institutions
• You must maintain accurate banking information with Stripe

6. Ratings and Reviews

When leaving ratings and reviews, you agree to:

• Provide honest and accurate feedback based on genuine experiences
• Upload authentic receipts when required
• Not post defamatory, abusive, or fraudulent content
• Not manipulate ratings through fake reviews

Tippas reserves the right to remove reviews that violate these terms.

7. Top Tippas Leaderboard

The Top Tippas leaderboard ranks service providers based on tip performance during specified time periods. By participating, you agree that:

• Rankings are calculated automatically based on total tips earned, number of unique tippers, and activity consistency
• Your profile and earnings data may be displayed on public leaderboards
• Achievement badges (including ranking badges) may be displayed on your profile
• You may opt out of leaderboard display by contacting support, though your tips and performance data will still be tracked
• Tippas reserves the right to remove providers from the leaderboard for suspicious activity, fraudulent tips, or terms violations
• Leaderboard calculations and algorithms may be updated at Tippas' discretion

Leaderboard rankings are for recognition purposes only and do not guarantee any additional benefits, prizes, or preferential treatment on the platform.

8. Tippas Debit Card Waitlist

Service providers may apply for the Tippas Debit Card through the platform. By applying, you agree to:

• Be added to a waitlist for the Tippas Debit Card
• Provide accurate information in your application
• Understand that approval is subject to review and eligibility requirements
• Understand that Tippas reserves the right to approve or deny applications at its sole discretion
• Receive email notifications about your application status
• Comply with additional terms and conditions that will apply to the debit card once issued

The Tippas Debit Card is subject to availability. Applying does not guarantee approval or issuance of a card.

9. Referral Program

Our referral program rewards users for inviting new users. Referral rewards are subject to:

• The referred user completing a qualifying action (e.g., first tip)
• Compliance with program rules and these Terms
• Tippas reserves the right to modify or terminate the program at any time
• Fraudulent referrals will result in forfeiture of rewards and possible account termination

10. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service
• Circumvent any security measures

11. Limitation of Liability

Tippas is a platform that connects service providers with customers. We are not responsible for:

• The quality or safety of services provided by service providers
• Disputes between users and service providers
• Any damages arising from the use of the Service
• Loss of data or unauthorized access to your account

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIPPAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Tippas, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination and Account Deletion

We may suspend or terminate your account at any time for violation of these Terms, including but not limited to misconduct, fraud, abuse, or any other reason at Tippas' sole discretion. Upon termination, all associated data including but not limited to your profile, tips, ratings, reviews, bookings, and messages will be permanently deleted. You may also delete your account at any time by contacting us at support@tippas.com.

14. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules. You waive your right to participate in class action lawsuits.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tippas operates, without regard to conflict of law principles.
